Terms of service
The agreement that covers browsing, offers, checkout and domain transfers on NamesShift.
These terms are an agreement between you and NamesShift Inc. ("NamesShift", "we") and apply to namesshift.com, the buyer account area and every domain transaction started through them.
1. The agreement
By browsing the site, sending an offer, creating an account or paying for a domain you accept these terms. If you do not accept them, do not use the service. If you are agreeing on behalf of a company, you confirm you are allowed to bind that company.
Our privacy policy and refund policy form part of this agreement.
2. What we sell
NamesShift sells domain names that we own and list ourselves. We are the seller in every transaction — we are not an auction platform, a broker for third parties or a registrar.
Registration, renewal, hosting, email and DNS for a domain after it is transferred are provided by the registrar you choose, under that registrar's terms. Those services are not included in the price you pay us.
3. Accounts
- You must give accurate details and keep them up to date — the transfer authorization email goes to the address on your account.
- You are responsible for activity under your account. Keep your password and sign-in codes private and tell us immediately if you suspect compromise.
- Accounts may be used by the person or company that created them. Do not create accounts to evade limits, spam the inbox or abuse the offer system.
- We may suspend an account that shows signs of fraud, chargeback abuse or attempts to interfere with the service.
4. Listings & prices
We try to describe every name accurately: extension, price, registration age, category and any comparable sale. Even so:
- Prices are in US dollars and may change without notice until an order is paid.
- A listing may be withdrawn or marked unavailable at any time, including while an offer is open.
- Only one buyer can own a name. If two orders arrive for the same name, the first completed payment wins and the other is refunded in full.
- Obvious pricing errors do not create a binding obligation. We will tell you and either honour the corrected price or cancel and refund you.
5. Offers
An offer is an invitation to negotiate, not a completed sale. It stays open for seven days unless we accept, counter or decline it. We may decline any offer without giving a reason, and an offer is only binding on us once we confirm acceptance in writing and payment is received.
Do not send an offer you cannot pay for. Repeated non-paying offers may lead to the account being restricted.
6. Payment
- Payments are processed by Paylio on a hosted checkout page. By paying you also accept Paylio's terms for the payment method you choose.
- Your order is not reserved until the payment is confirmed. Bank or wallet delays are outside our control.
- You are responsible for any currency conversion fee charged by your bank or wallet, and for taxes that apply in your jurisdiction.
- If a payment is reversed, blocked or flagged as fraudulent, we may cancel the order and reclaim the domain if it was already transferred.
7. Transfer & delivery
We start the transfer after payment clears and after you confirm the destination registrar account. Delivery means the domain is successfully transferred into that account or pushed to it by the registrar.
- You must approve the registrar's authorization email and provide any information the registrar requires.
- Most transfers complete in one to five days; registry-mandated waits can extend this to seven days or more.
- We are not responsible for delays caused by your registrar, an incorrect destination account, an expired authorization or your failure to respond.
- If you do not provide the transfer details within 30 days of payment, we may store the name for you, cancel the order or refund it minus any payment fees.
8. Refunds
Refund eligibility is set out in the refund policy. In short: you have seven days after delivery to request a refund while the transfer is still incomplete. Once a name is transferred and unlocked in your account, the sale is final.
9. Acceptable use
You may not use NamesShift or a domain bought through it for unlawful purposes, including fraud, phishing, malware distribution, harassment, or infringement of intellectual property. You may not attempt to disrupt the site, scrape it at a rate that degrades service, probe for vulnerabilities without permission, or resell access to it.
If a purchased domain is used unlawfully, we cooperate with registrars and law enforcement as required. Reports can be sent to abuse@namesshift.com or through the abuse form.
10. Intellectual property
The site design, copy, code and catalogue data belong to NamesShift. You may not copy them for commercial use without written permission. Domain names themselves are not copyrightable; we sell the registration rights, not any trademark that a third party may hold in a similar word.
You are responsible for clearing trademarks before using a purchased name. We flag obvious conflicts during vetting but cannot guarantee that no third party will object.
11. Liability
The service is provided as it is. To the extent the law allows, we exclude implied warranties and are not liable for lost profits, lost business or indirect damages arising from the use of a domain or this site.
Our total liability for any claim connected to an order is limited to the amount you paid for that order. Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud.
12. Termination
You can stop using the service at any time and ask us to close your account. We may suspend or terminate access if these terms are broken, if payment is reversed, or if we are required to by law. Sections on payment, liability and governing law survive termination.
13. Governing law & disputes
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Before starting formal proceedings, contact us at legal@namesshift.com and give us 30 days to resolve the issue — most disputes here are a misunderstanding about a transfer stage.
Nothing here prevents a consumer from bringing a claim in the courts of their own country where local law grants that right.
